Abadecom Manufacturer S,L., in application of current regulations on the protection of personal data, informs that the personal data collected through the forms on the website https://www.abadecom.com are included in the specific automated user files of the services of Abadecom Manufacturer S,L.
The collection and automated processing of personal data has the purpose of maintaining the commercial relationship and performing information, training, advisory and other activities characteristic of Abadecom Manufacturer S.L.
These data will only be disclosed to those entities that are necessary for the sole purpose of fulfilling the previously stated purpose.
Abadecom Manufacturer S.L. adopts the necessary measures to guarantee the security, integrity and confidentiality of data in accordance with the provisions of Organic Law 15/1999 of 13 December on the Protection of Personal Data (LOPD).
The user may at any time exercise the rights of access, objection, rectification and cancellation recognised in the aforementioned LOPD. These rights may be exercised by the user themselves via email or at the address Carrer de la Travessía 15B, Edificio Innsomnia, 46024, Valencia, Spain.
The user states that all the data provided by them is true and correct, and undertakes to keep it updated, communicating any changes to Abadecom Manufacturer S.L.
Data collected by users of the services
Where the user includes files containing personal data on the shared hosting servers, Abadecom Manufacturer S.L. shall not be held liable for the user's failure to comply with the LOPD.
Data retention in compliance with the LSSI
Abadecom Manufacturer S.L. informs that, as a data hosting service provider and pursuant to the provisions of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI), it retains for a maximum period of 12 months the information essential to identify the origin of the hosted data and the time at which the provision of the service began. The retention of this data does not affect the secrecy of communications and may only be used within the framework of a criminal investigation or for the safeguarding of public security, being made available to judges and/or courts or the Ministry that so requires. The communication of data to the State Law Enforcement Agencies shall be carried out in accordance with the provisions of the regulations on the protection of personal data.
Intellectual property rights https://www.abadecom.com
Abadecom Manufacturer S.L. holds all copyright, intellectual and industrial property rights, “know-how” and any other rights relating to the contents of the website https://www.abadecom.com and the services offered therein, as well as the programmes necessary for its implementation and related information. The reproduction, publication and/or non-strictly private use of the contents of the website, in whole or in part, is not permitted https://www.abadecom.com without prior written consent.
Software intellectual property
The user must comply with the third-party programmes made available to them by Abadecom Manufacturer S.L., even if they are free of charge and/or publicly available.
Abadecom Manufacturer S.L. holds the necessary exploitation and intellectual property rights for the software.
The user acquires no right or licence whatsoever through the contracted service, regarding the software necessary for the provision of the service, nor regarding the technical service monitoring information, with the exception of the rights and licences necessary for the fulfilment of the contracted services and solely for the duration thereof. For any action that exceeds the fulfilment of the contract, the user shall require written authorisation from Abadecom Manufacturer S.L., and the user is prohibited from accessing, modifying, or viewing the configuration, structure and files of the servers owned by Abadecom Manufacturer S.L., assuming the civil and criminal liability arising from any incident that may occur on the servers and security systems as a direct consequence of negligent or malicious action on their part.
Intellectual property of the hosted content
Any use of the services provided by Abadecom Manufacturer S.L. that is contrary to intellectual property legislation is prohibited, and in particular:
Use that is contrary to Spanish law or that infringes the rights of third parties.
The publication or transmission of any content that, in the opinion of Abadecom Manufacturer S.L., is violent, obscene, abusive, illegal, racist, xenophobic or defamatory.
Cracks, software serial numbers or any other content that infringes the intellectual property rights of third parties.
The collection and/or use of personal data of other users without their express consent or in contravention of the provisions of Organic Law 15/1999 of 13 December on the Protection of Personal Data.
The use of the domain's mail server and email addresses for sending unsolicited bulk email.
The user bears full responsibility for the content of their website, the information transmitted and stored, hypertext links, third-party claims and legal actions with regard to intellectual property, third-party rights and the protection of minors. The user is responsible with respect to laws and regulations in force and the rules that have to do with the operation of the online service, e-commerce, copyright, the maintenance of public order, as well as universal principles of Internet use.
The user shall indemnify Abadecom Manufacturer S.L. for the expenses generated by the joinder of Abadecom Manufacturer S.L. in any lawsuit whose liability is attributable to the user, including legal defence fees and expenses, even in the event of a non-final judicial decision.
Protection of hosted information
Abadecom Manufacturer S.L. takes backups of the content hosted on its servers, but it is not liable for the loss or accidental deletion of data by users. Similarly, it does not guarantee the full recovery of data deleted by users, as the said data may have been erased and/or modified during the period of time elapsed since the last backup. The services offered, except for specific backup services, do not include the recovery of content kept in backups made by Abadecom Manufacturer S.L. when such loss is attributable to the user; in this case, a fee will be determined according to the complexity and volume of the recovery, always subject to prior acceptance by the user. The recovery of deleted data is only included in the service price when the loss of content is due to causes attributable to Abadecom Manufacturer S.L.
Commercial communications
In application of the LSSI, Abadecom Manufacturer S.L. will not send advertising or promotional communications by email or other equivalent electronic means of communication that have not been previously requested or expressly authorised by the recipients thereof.
In the case of users with whom there is a prior contractual relationship, Abadecom Manufacturer S.L. is authorised to send commercial communications concerning products or services from Abadecom Manufacturer S.L. that are similar to those that were initially the subject of the contract with the customer. In any case, the user may request not to be sent further commercial information through the Customer Service channels, after proving their identity.
